Overtime - Minimum Wage - Nonpayment
Have you been laid off recently? Are you receiving Workers Comp? If you're not working now you need to determine if you were payed in full by your last employer. Issues to consider include:
- Were your commissions and bonuses calculated properly?
- Did you work through an unpaid lunch break?
- Did your employer reimburse you for all work related expenses?
- Did you receive compensation for all your accrued benefits?
As an employee are you being paid according to the law? According to the Fair Labor Standards Act (FLSA) your employer is required to pay you at least $6.55 per hour. Some states have laws that make the minimum wage even higher. An employer is required to pay you overtime wage payments as well. The FLSA requires that employers to pay non-exempt employees at a rate of not less than one and half times their regular rate of pay for hours worked in excess of forty hours in a workweek. You need a competent professional, like the attorneys at Charlip Law Group, to determine what your case entails.
Have you suffered from nonpayment of wages? Legally an employer is required to pay you for your work. It makes no difference whether you are an hourly employee or have an employment contract you are protected by the FLSA in regards to receiving your pay. The same is true for commissioned workers. If your commissions were not completely paid, you are entitled by law to your money.
