Spousal Support PDF Print

Alimony is a payment made after a divorce from one spouse to the other. It is meant to allow an individual to maintain a lifestyle similar to that lived during the marriage. In a divorce, after the marital assets have been distributed, the court will decide what, if any, spousal support is needed. Many factors are considered when determining alimony such as:

  • Duration of the marriage
  • Income levels of both spouses
  • Each individual's earning potential
  • Asset and debt division

In Florida alimony can be permanent or rehabilitative.

Permanent alimony is awarded for an indefinite amount of time. Generally, one spouse can be eligible to receive permanent alimony if the marriage was long-term or if he or she displays uneven earning potential. It is important to note that permanent alimony is modifiable if circumstances change.

Rehabilitative alimonyis meant to provide a spouse with money that will allow he/she to acquire the education, skills or other resources necessary to become self supporting.
