Prenuptial Agreements

Congratulations on your upcoming marriage and your decision to consider a prenuptial agreement beforehand. Prenuptial agreements are simply contracts entered into by prospective spouses with the purpose of clearly establishing the rights, duties and obligations of the parties in the event of a termination of the marriage either by death or divorce. Also called "ante-nuptial" agreements, these contracts are enforceable in the state of Florida (even if one party receives nothing) as long as certain conditions are met. This agreement must be signed by both prospective spouses. There is a full financial disclosure so both parties know where they stand. And the agreement must be fair.

The decision to marry is exciting; but can leave you with a sense of uncertainty. There are benefits to prenuptial agreements which include: Courts favor properly executed prenuptial agreements because they make it easier to decide the issues of alimony, division of property and debts and even certain aspects of parental responsibility. Since many of the complicated issues that arise in a divorce proceeding are already resolved, a prenuptial agreement can help you keep your court costs low in the event you do get divorced.

Postnuptial Agreements

A postnuptial agreement is a contract entered into between spouses after they are married. This is a useful tool to change your prenuptial agreement, allow you to enter into a contract that you wanted before you married, or so you can live separately from your spouse with an agreement that states the terms of your separation and potential divorce.
