If you are an employer with 50 employees or more you are required, under the federal Family and Medical Leave Act (FMLA) to extend up to 12 weeks of unpaid leave a year, with benefits, to care for a new child, to care for a family member with a serious medical condition, or for an employee to recuperate from a serious medical condition. Some states require company's with fewer than 50 employees to provide this leave.
As an employee you should know that the FMLA overlaps with the worker's compensation laws and the Americans With Disabilities Act. You are entitled to the benefits of whichever law is most generous. Each state has different laws. Some of them are:
- Comprehensive family and medical leave laws
- Pegnancy disability leave laws
- Adoption leave laws
- Small necessities laws
- Domestic violence leave laws
