Due to their considerable experience with consumer class actions, Charlip Law Group, LC has been approached by a number of medical professionals seeking their assistance with the organization and maintenence of a consumer class action against Brican America and/or Professional Solutions Financial Services. These companies (and in some cases other leasing companies besides Professional Solutions), have extensively marketed an in office advertizing package (consisting of a plasma T.V., computer and associated software) to medical professionals including doctors, dentists, optometrists and other professionals nationwide. These systems were largely significantly overpriced, however Brican America was able to sell the systems as a lease transaction through a practice that many of theiir customers have said was misleading and deceptive. What Brican America representatives did and what was the company sales approach and marketing scheme was to promise prospective customers that the systems would not cost them anything because Brican would enter into a marketing agreement that would generate monthly payments equivalent to the lease payments the customers would be obligating themselves to pay. Additionally, Brican promised, say these customers, that upon demand, it would cancel or "buy-back" their leases.
Over time numerous complaints about Brican surfaced, (see for example those chronicled here: http://www.cafepharma.com/boards/showthread.php?t=397139) and "Leasing News" posted an alert regarding Brican America, Miami, Florida on October 5, 2009 being sued over its leasing portfolio by Professional Solutions Financial Systems regarding their "marketing agreement" not being disclosed as part of the lease documents. This suit was only recently dismissed and that dismissal begs the question of whether Professional Solutions Financial Systems was and is chargeable with knowledge, participation or approval of this scheme whereby its leases would be cancelable. Not surprisingly, Brican America has largely ceased making marketing payments and seems to be "circling its wagons".
